By accessing our website, requesting a quote, or hiring DS Contracting Services for any project, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms and conditions referenced herein.

2. Services Description

DS Contracting Services provides professional home remodeling and construction services in the Greater Houston area, including but not limited to:

  • Bathroom and kitchen remodeling
  • Flooring installation
  • Windows, doors, and siding installation
  • Outdoor patio construction
  • Fencing installation
  • Concrete work and driveways

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about your project requirements
  • Ensure access to the work area during scheduled times
  • Make timely decisions regarding materials, colors, and design choices
  • Keep the work area clear of personal belongings
  • Provide necessary utilities (electricity, water) for the work
  • Obtain any required HOA approvals or permits

4. Quotes and Estimates

  • All quotes are valid for 30 days from issuance
  • Quotes are based on current material prices and labor rates
  • Additional work requested after project commencement will be documented in a change order
  • Estimates may be adjusted based on unforeseen conditions discovered during construction

5. Payment Terms

  • Deposit: A deposit of 30-50% is required to begin work
  • Progress Payments: Payments are due at specified project milestones
  • Final Payment: Final payment is due upon project completion
  • Late Payments: Late payments may incur interest charges
  • Payment Methods: We accept cash, check, and major credit cards

6. Project Timeline

  • Projected timelines are estimates based on normal conditions

    • Weather delays, material shortages, or unforeseen issues may extend timelines

  • We will notify you promptly of any schedule changes
  • Client-requested changes may affect the project timeline

7. Warranty

  • Workmanship Warranty: We warrant our workmanship for one year from completion
  • Material Warranty: Manufacturer warranties apply to all materials used
  • Warranty does not cover damage caused by improper maintenance or normal wear and tear
  • Warranty claims must be submitted in writing within the warranty period

8. Limitation of Liability

To the fullest extent permitted by law, DS Contracting Services shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Delays caused by factors beyond our control
  • Damage to personal property left in the work area
  • Amounts exceeding the total contract value

9. Cancellation Policy

  • Cancellations made more than 72 hours before work begins: Full refund minus administrative fees
  • Cancellations made within 72 hours of work start: Deposit is non-refundable
  • Cancellations after work has begun: Client is responsible for all work completed and materials ordered

10. Permits and Regulations

  • Client is responsible for obtaining HOA approvals
  • DS Contracting Services will obtain required building permits
  • Permit costs are the responsibility of the client
  • All work will comply with local building codes and regulations

11. Property Protection

While we take reasonable precautions to protect your property:

  • Construction dust and debris are normal and unavoidable
  • We are not responsible for pre-existing conditions
  • Please remove valuables from the work area
  • We recommend moving vehicles away from the work area

12. Website Use

  • Content on our website is for informational purposes only
  • We reserve the right to modify website content at any time
  • Unauthorized use of our website or content is prohibited
  • We do not guarantee uninterrupted website access

13. Indemnification

You agree to indemnify and hold DS Contracting Services harmless from any claims, damages, or expenses arising from your breach of these terms or your use of our services.

14. Dispute Resolution

  • We strive to resolve all disputes amicably
  • Any unresolved disputes will be handled through mediation
  • If mediation fails, disputes will be resolved through binding arbitration
  • All disputes will be governed by Texas law
